Sixty Five (65) out of 140 IPOB detained activists regains freedom, at the completion of Bail perfection by IPOB.
The Court ordered that the number of released activists should be in Two batches, to minimize workload and security risk, due to the massive numbers.
The 140 IPOB activists were granted Bail by the Enugu State Magistrate Court presided by Her Lordship Chioke on the 7th Of June, 2019, without the provision of the defendants in court.
The matter which was previously slated for COMPLIANCE OF REPORT, recorded NO Appearance for the prosecuting counsels, but all IPOB defending counsels announced their appearances.
Defendants are not in court due to logistics issues, considering the massive number 140 for Treason, but the court shall give the prison official an opportunity to speak, stated by the presiding Magistrate Chioke.
ASP Emmanuel Udeh representative of the Enugu State Prisons, was asked to inform the court of reasons for not arraigning the defendants.
“Your Lordship the inmates are presently in Prison custody because, we don’t have the logistics and security backups to bring them to court”.
IPOB Legal Counsel from Ejiofor’s chambers, argued with legal facts; “My Lord the charge which has no proof of evidence that links the defendants to the offence before the court, shows that they are trumped and lack merit.
To butress his argument, he drew the attention of the court to 88B, Appeal Authority in the case of Adesanya Theophilus Vs FRN 2016, Anekwe Vs COP 1996 and demanded the court grants the defendants bail on liberal conditions.
In furtherance, one of the defending cousels Barrister .E. Odu alligned himself with his learned friends submision and stated the Prosecution should halt their unnecessary excuses, which holds no water. He stated that is an obvious disrespect of the court, for the Prison officer and not Legal representative from the prosecution, giving excuses of no logistics and security, from same people who detained and arraigned them in court.
The Court went into a One hour recession and proceeds for ruling.
“After hearing the counsels on the first day of arraignment, the 140 defendants were remanded in Prisons, on the charges of treasonable felony.
The defendants have conducted themselves civily and has never gotten involved in any illicit acts. The defendants have been remanded for 14days and there is no evidential proof to buttress their claims.
An accused is not guilty until proven one.
Therefore, The Court grants Bail to the 140 accused persons, in The like sum of One Million Naira, A business Man with goods worth One Million Naira with evidence of tax clearance to Surety ten persons or Surety with Landed Properties worth one Million Naira or a Civil Servant not less than level ten with evidence of tax clearance.
Both the Surety and accused persons shall submit full length of photographs to the court.
The Bail conditions was dully perfected, hence the release of the activists.
Friends and well wishers stormed the court to welcome the activists, in celebration.
The activists reaffirms their support for Biafra and in celebration joins Family members home.
